This is known as lawyer professional privilege (LPP).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">As the <\/span><a href=\"https:\/\/www.sra.org.uk\/\"><span style=\"font-weight: 400\">Solicitors Regulation Authority<\/span><\/a><span style=\"font-weight: 400\"> (SRA) <\/span><a href=\"https:\/\/www.sra.org.uk\/solicitors\/guidance\/confidentiality-client-information\/\"><span style=\"font-weight: 400\">puts it<\/span><\/a><span style=\"font-weight: 400\">, solicitors must:<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400\">Keep the affairs of current and former clients confidential unless disclosure is required or permitted by law or the client consents.<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400\">This duty continues even after the solicitor-client relationship ends. If a client passes away, confidentiality rights are transferred to their personal representatives. Law firms must have robust systems to ensure confidential information is always protected.<\/span><\/p>\n<h2>What doesn\u2019t need to be confidential?<\/h2>\n<p><span style=\"font-weight: 400\">Confidentiality applies to all information regarding the retainer for which a firm is instructed. In other words, if a client tells you they\u2019re planning to commit a crime, you should feel no pressure to withhold this information from the authorities. <\/span><\/p>\n<h2>Client confidentiality in the information age<\/h2>\n<p><span style=\"font-weight: 400\">More information gets shared on social media and via apps each day. Every day:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">WhatsApp users send <\/span><a href=\"https:\/\/www.oberlo.co.uk\/blog\/whatsapp-statistics#:~:text=100%20billion%20messages%20are%20sent,million%20businesses%20using%20WhatsApp%20Business.\"><span style=\"font-weight: 400\">100 billion<\/span><\/a><span style=\"font-weight: 400\"> messages\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">LinkedIn users send <\/span><a href=\"https:\/\/www.cognism.com\/blog\/linkedin-statistics\"><span style=\"font-weight: 400\">2 million<\/span><\/a><span style=\"font-weight: 400\"> posts<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Instagram users post <\/span><a href=\"https:\/\/bernardmarr.com\/how-much-data-do-we-create-every-day-the-mind-blowing-stats-everyone-should-read\/#:~:text=There%20are%20600%20million%20Instagrammers,videos%20are%20shared%20on%20Instagram\"><span style=\"font-weight: 400\">95 million<\/span><\/a><span style=\"font-weight: 400\"> photos\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">If you\u2019re a lawyer, you need to take extra care when using social media. Your social media posts could inadvertently breach client confidentiality in many ways.<\/span><\/p>\n<p><span style=\"font-weight: 400\">For instance, if you use Facebook to check in at a coffee shop during a client meeting, you could inadvertently disclose your client\u2019s location as well. This may be an issue if your client wishes to remain anonymous or if they don\u2019t want it to be known that they\u2019re using legal representation.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Photos can also be problematic. You should always be hyper-aware of what might be in the eye of a camera lens. Your daughter could take an impromptu photo while you\u2019re catching up on some work at the dining room table; if there\u2019s any sensitive information visible in the image, you need to make sure that photo doesn\u2019t get posted online (and is deleted from her device).<\/span><\/p>\n<p><span style=\"font-weight: 400\">It\u2019s also worth noting that the need for confidentiality is reflected in law firm clients\u2019 communication preferences. Failure to protect your clients\u2019 valuable information will land your firm in hot water, threaten a case\u2019s outcome, and will erode any trust you\u2019ve built.
